Terms of Service

These terms are an agreement between you and [Noleen Robertson], trading as Get Noticed Studio ("we", "us"). They apply when you use the Get Noticed Studio app at app.getnoticedstudio.co.za (the "Service"). Please read them together with our Privacy Policy, Refund & Cancellation Policy and Acceptable Use Policy. By creating an account, you agree to these terms.

1. Who we are

The details below are required by section 43 of the Electronic Communications and Transactions Act, 2002 (ECTA).

2. The Service

Get Noticed Studio is an online tool that helps you create short videos with AI. It includes:

  • AI presenter videos made from your photo and a voice
  • Text to Video using stock clips and music
  • AI voices, including a copy of your own voice ("My voice")
  • subtitles, templates, scenes and exporting in other shapes

We use trusted third-party services to do this. They are listed in our Privacy Policy.

AI results can contain mistakes, such as mispronounced words, imperfect lip movement or stock clips that don't quite match. Always check a video before you publish it.

3. Your account

  • You must be 18 or older to create an account.
  • Give us a real email address, keep your password secret, and tell us straight away if you think someone else has used your account.
  • You're responsible for what happens in your account.
  • You can delete your account at any time in Settings → Danger zone. This permanently deletes your videos, saved voices, scenes and templates.

4. Plans, prices and payment

  • Free: 3 videos a month, up to 30 seconds each, with a watermark.
  • Starter: R149 a month (or R1,490 a year). 30 videos a month, up to 90 seconds each, no watermark, 5 "My voice" videos a month, 1 saved voice.
  • Pro: R399 a month (or R3,990 a year). 100 videos a month, up to 90 seconds each, no watermark, 25 "My voice" videos a month, 3 saved voices.
  • All prices are in South African rand (ZAR) and are the full amount you pay.
  • Payments are processed securely by Paystack. We never see or store your full card number.
  • Paid plans renew automatically at the end of each billing period (monthly or yearly) until you cancel.
  • Monthly limits reset at each renewal. Unused videos don't carry over.
  • If a renewal payment fails, your account moves to the Free plan until payment succeeds. You don't lose your saved videos.
  • We may change prices or plan limits. We'll give you at least 30 days' notice by email, and the change applies from your next renewal. If you don't agree, you can cancel before then.

5. Cancelling and refunds

You can cancel at any time. Our Refund & Cancellation Policy explains how cancelling works, including your 7-day cooling-off right under ECTA.

6. Your content

  • You own what you upload and create: your photos, recordings, scripts, logos and finished videos.
  • You give us permission to store, process and transform your content only to provide the Service to you: for example, to make your video, copy your voice for a job, or show your projects back to you. We don't use your content to advertise, and we don't sell it.
  • You confirm that you have the right to use everything you upload. This includes people's faces and voices, logos, music and video.
  • Stock clips and music:
    • Text to Video uses clips from Pixabay under the Pixabay Content License, plus music from our built-in library. You may use them as part of the videos you make with the Service, including commercially.
    • You may not extract them and sell or distribute them on their own.
    • Some clips show trademarks or recognisable people. Check that your final video is suitable for your use.

7. Acceptable use

You must follow our Acceptable Use Policy. In particular, you may not use anyone's face or voice without their permission, and you may not create content that deceives, harasses or harms people.

8. Availability and changes

  • We work hard to keep the Service running, but we can't promise it will always be available or error-free.
  • We may improve, change or remove features. If we remove a major paid feature, you may cancel and we'll refund the unused part of your current paid period.

9. Suspension and termination

We may suspend or close an account that breaks these terms or the Acceptable Use Policy, puts other people at risk, or is used for fraud. Where reasonable, we'll tell you first and give you a chance to fix the problem. If we close your account for a reason that isn't your fault, we'll refund any unused paid period.

10. Liability

  • To the extent the law allows, we provide the Service "as is". We are not liable for indirect or consequential losses, such as lost profits or lost business.
  • Our total liability to you is limited to the amount you paid us in the 3 months before the claim.
  • Nothing in these terms limits your rights under the Consumer Protection Act, 2008, ECTA or any other law that can't be excluded.
  • You're responsible for the content you publish. If someone makes a claim against us because of content you uploaded or published in breach of these terms, you agree to cover our reasonable costs.

11. Changes to these terms

  • We may update these terms. For important changes, we'll email you at least 14 days before they apply.
  • The "Last updated" date at the top always shows the current version.
  • If you keep using the Service after a change applies, you accept the new terms.

12. Complaints and law

  • If you have a problem, email hello@getnoticedstudio.co.za. We'll reply within 5 business days and try to resolve it fairly.
  • If we can't agree, you may contact the National Consumer Commission or another dispute-resolution body you're entitled to use.
  • These terms are governed by the law of the Republic of South Africa.
